§ 1 Geltungsbereich

(1) Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen über den Onlineshop Italianmode. Vertragspartner ist Surinder Singh (Italianmode) (nachfolgend „wir"). Alle Kontaktdaten findest du im Impressum.

(2) Verbraucher:in ist, wer ein Geschäft abschließt, das nicht zum Betrieb seines bzw. ihres Unternehmens gehört (§ 1 KSchG).

§ 2 Vertragsabschluss

(1) Die Darstellung der Produkte im Onlineshop ist kein verbindliches Angebot, sondern eine Einladung zur Bestellung.

(2) Mit einem Klick auf „Zahlungspflichtig bestellen" gibst du ein verbindliches Angebot zum Kauf der Waren in deiner Tasche ab. Vor dem Absenden kannst du alle Angaben prüfen und korrigieren.

(3) Direkt nach dem Absenden erhältst du eine automatische E-Mail über den Eingang deiner Bestellung. Diese Eingangsbestätigung ist noch keine Annahme deines Angebots.

(4) Bei Online-Zahlung nehmen wir dein Angebot an, sobald die Zahlung erfolgreich abgeschlossen ist; damit kommt der Vertrag zustande. Du erhältst die Bestellbestätigung mit diesen AGB und der Widerrufsbelehrung per E-Mail. Bei Zahlung per Überweisung kommt der Vertrag zustande, wenn wir deine Bestellung innerhalb von 2 Werktagen per E-Mail annehmen (Auftragsbestätigung). Bis dahin bist du an deine Bestellung gebunden; nehmen wir sie in dieser Frist nicht an, bist du nicht mehr gebunden. Die Auftragsbestätigung enthält unsere Bankverbindung, diese AGB und die Widerrufsbelehrung.

(5) Ist ein Artikel nicht mehr verfügbar, informieren wir dich umgehend. Bereits geleistete Zahlungen erstatten wir unverzüglich.

(6) Vertragssprachen sind Deutsch und Englisch. Bei Abweichungen gilt die deutsche Fassung. Wir speichern den Vertragstext und senden ihn dir mit der Auftragsbestätigung zu.

§ 3 Preise und Versandkosten

(1) Alle Preise sind Endpreise in Euro (no VAT, small businesskeine USt., Kleinunternehmer). Als Kleinunternehmer gemäß § 6 Abs. 1 Z 27 UStG verrechnen wir keine Umsatzsteuer.

(2) Zusätzlich fallen Versandkosten von €4.50€ 4,50 pro Bestellung an; ab einem Bestellwert von €30.00€ 30,00 ist der Versand gratis. Die Versandkosten werden in der Tasche und an der Kasse vor Abgabe der Bestellung angezeigt. Details findest du unter Versand & Zahlung.

(3) Der Mindestbestellwert beträgt €15.00€ 15,00.

§ 4 Zahlung

(1) Du kannst online bezahlen (z. B. Kreditkarte, Debitkarte, Apple Pay, Google Pay, EPS; welche Zahlungsarten angeboten werden, siehst du auf der Zahlungsseite) oder per Vorauskasse (Banküberweisung).

(2) Die Online-Zahlung wickelt der Zahlungsdienstleister Stripe Payments Europe, Ltd. (Dublin, Irland) auf seiner gesicherten Zahlungsseite ab. Deine Kartendaten erhalten wir nicht. Der Betrag wird bei Abschluss der Bestellung belastet.

(3) Bei Überweisung erhältst du unsere Bankverbindung mit der Auftragsbestätigung. Bitte überweise den Gesamtbetrag innerhalb von 7 Tagen nach Erhalt der Auftragsbestätigung. Geht die Zahlung nicht fristgerecht ein, erinnern wir dich per E-Mail. Erfolgt danach innerhalb von weiteren 7 Tagen keine Zahlung, können wir vom Vertrag zurücktreten.

§ 5 Lieferung

(1) Wir liefern nach Austria, GermanyÖsterreich, Deutschland.

(2) Wir versenden nach Eingang der Zahlung mit der Österreichischen Post. Die Ware ist spätestens 7 Werktage nach Zahlungseingang bei dir. Details findest du unter Versand & Zahlung.

(3) Bei Verbraucher:innen geht die Gefahr erst mit der Übergabe der Ware an dich oder an eine von dir bestimmte, vom Beförderer verschiedene Person über (§ 7b KSchG).

§ 6 Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.

§ 7 Rücktrittsrecht

Als Verbraucher:in hast du ein 14-tägiges Rücktrittsrecht. Alle Einzelheiten und das Formular findest du in der Widerrufsbelehrung.

§ 8 Gewährleistung

Es gelten die gesetzlichen Gewährleistungsbestimmungen (Verbrauchergewährleistungsgesetz bzw. ABGB). Die Gewährleistungsfrist beträgt zwei Jahre ab Lieferung. Bitte melde Mängel an shop@italianmode.at.

§ 9 Haftung

Wir haften für Schäden bei Vorsatz und grober Fahrlässigkeit. Gegenüber Verbraucher:innen ist die Haftung für leichte Fahrlässigkeit nur ausgeschlossen, soweit dies gesetzlich zulässig ist. Die Haftung für Personenschäden bleibt in jedem Fall unberührt.

§ 10 Datenschutz

Wie wir deine Daten verarbeiten, erklären wir in der Datenschutzerklärung.

§ 11 Anwendbares Recht und Gerichtsstand

(1) Es gilt österreichisches Recht unter Ausschluss des UN-Kaufrechts. Für Verbraucher:innen gilt diese Rechtswahl nur, soweit dadurch nicht der Schutz durch zwingende Bestimmungen des Rechts ihres gewöhnlichen Aufenthaltsstaats entzogen wird.

(2) Für Klagen gegen Verbraucher:innen ist das Gericht zuständig, in dessen Sprengel ihr Wohnsitz, gewöhnlicher Aufenthalt oder Ort der Beschäftigung liegt (§ 14 KSchG).

§ 12 Schlussbestimmungen

Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§ 1 Scope

(1) These general terms and conditions apply to all orders placed in the Italianmode online shop. Your contract partner is Surinder Singh (Italianmode) ("we"). All contact details are in the legal notice (Impressum).

(2) A consumer is anyone who enters into a transaction that is not part of the operation of their business (§ 1 KSchG).

§ 2 Conclusion of the contract

(1) The presentation of products in the online shop is not a binding offer but an invitation to order.

(2) By clicking "Order with obligation to pay" you make a binding offer to buy the items in your bag. Before sending you can check and correct all details.

(3) Right after sending you receive an automatic email confirming receipt of your order. This receipt is not yet an acceptance of your offer.

(4) If you pay online, we accept your offer as soon as the payment has been completed successfully; this concludes the contract. You receive the order confirmation with these terms and the withdrawal policy by email. If you pay by bank transfer, the contract is concluded when we accept your order by email within 2 working days (order confirmation). Until then you are bound by your order; if we do not accept it within this period, you are no longer bound. The order confirmation contains our bank details, these terms and the withdrawal policy.

(5) If an item is no longer available, we will tell you straight away and refund any payment already made without delay.

(6) The contract languages are German and English. We store the contract text and send it to you with the order confirmation.

§ 3 Prices and shipping costs

(1) All prices are final prices in euros (no VAT, small businesskeine USt., Kleinunternehmer). As a small business under § 6 (1) 27 of the Austrian VAT Act (UStG), we do not charge VAT.

(2) Shipping costs of €4.50€ 4,50 per order are added; shipping is free from an order value of €30.00€ 30,00. They are shown in your bag and at checkout before you place the order. See shipping & payment.

(3) The minimum order value is €15.00€ 15,00.

§ 4 Payment

(1) You can pay online (for example credit card, debit card, Apple Pay, Google Pay, EPS; the payment page shows which methods are offered) or by bank transfer in advance.

(2) Online payment is handled by the payment provider Stripe Payments Europe, Ltd. (Dublin, Ireland) on its secure payment page. We never receive your card details. The amount is charged when you complete the order.

(3) For bank transfer you receive our bank details with the order confirmation. Please transfer the total within 7 days of receiving the order confirmation. If payment does not arrive in time, we will remind you by email. If no payment follows within another 7 days, we may withdraw from the contract.

§ 5 Delivery

(1) We deliver to Austria, GermanyÖsterreich, Deutschland.

(2) We ship with Austrian Post once your payment has arrived. The goods reach you within 7 working days after your payment. See shipping & payment.

(3) For consumers, the risk passes only when the goods are handed over to you or to a third party named by you who is not the carrier (§ 7b KSchG).

§ 6 Retention of title

The goods remain our property until paid in full.

§ 7 Right of withdrawal

As a consumer you have a 14-day right of withdrawal. All details and the form are in the withdrawal policy.

§ 8 Warranty

The statutory warranty rules apply (Consumer Warranty Act or ABGB). The warranty period is two years from delivery. Please report defects to shop@italianmode.at.

§ 9 Liability

We are liable for damage caused intentionally or through gross negligence. Towards consumers, liability for slight negligence is excluded only as far as the law allows. Liability for personal injury is never excluded.

§ 10 Data protection

How we process your data is explained in our privacy policy.

§ 11 Applicable law and jurisdiction

(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only as far as it does not remove protection granted by mandatory provisions of the law of their country of habitual residence.

(2) Claims against consumers can only be brought before the court where they live, habitually reside or work (§ 14 KSchG).

§ 12 Final provisions

If any provision of these terms is invalid, the remaining provisions stay valid.
